Premises Liability claims arise when a person is injured on a property owned or controlled by another person or business. In Texas, premises cases are very difficult to win because laws are very favorable to premises owners. To prevail in a premises liability case, an injured party must prove duty, breach, proximate cause, and damage. It must be shown that an unreasonably dangerous condition existed on the premises, that the condition was likely to cause and did in fact cause injury, that the condition was actually known or should have been known to the premises owner, and that the premises owner had a reasonable time in which to correct the dangerous premises condition but failed to do so. |
